Find The Right Type Of Power Of Attorney For You

There are two types of Powers of Attorney. One gives your Agent discretion to make medical decisions for you in the event you are unable. This type of Power of Attorney is known as a Living Will, Advance Directive, or Appointment of Health Care Agent. This document allows your Agent to take you off of life support if you are in a terminal condition and are not reasonably expected to recover.

The second type of Power of Attorney allows your Agent to make financial decisions for you in the event you are unable. For example, your financial agent could sign contracts on your behalf to hire caregivers and could continue to pay your bills.

The powers given to your Agent under both types of Powers of Attorney terminate upon your death. At that time, the Personal Representative you designated in your Will, and/or the Trustee you designated in your Revocable Living Trust will assume responsibility for your estate.

If you retain our lead attorney, Suzanne B. Simpson, she will explain the estate planning process, a timetable for completion and your participation in the plan. Our standard document package includes a will, medical power of attorney for health care, financial power of attorney, durable power of attorney, and a living will, also known as a medical directive and appointment of health care agent.
